GENERAL TERMS AND CONDITIONS SPORTCLUB MATCH.

These terms and conditions apply to all members and non-members, tenants, and collaborating self-employed trainers (freelancers) of Sportclub Match.

ARTICLE 1:

  1. By registering, you declare to accept and abide by these general terms and conditions and the house rules of Sportclub Match. The general terms and conditions and the house rules can be found at www.sportclubmatch.nl
  2. Registration: a registration that makes you a member of Sportclub Match. This can be done in one of the ways described in Article 2a.
  3. Minimum age: The minimum age to become a member at Sportclub Match is 16 years.
  4. Members: You can become a member if you are a natural person. A Sportclub Match employee can ask you to prove your membership by showing identification.
  5. Membership agreement or agreement: the agreement formed between Sportclub Match and the member upon registration. These general terms and conditions are also part of your agreement.

ARTICLE 2: BECOMING A MEMBER AND ACCESS

  1. You are welcome to join Sportclub Match. You can do this in the following ways:
    1. On the website by logging in via (www.match.baanreserveren.nl); or
    2. At the club by completing a paper registration form at the desk. A passport-sized photograph for a membership card is compulsory.
    3. If you register via the website, you have the right to cancel your membership without giving a reason within 14 days of the day of registration. You can do this in one of the ways described in article 10c of these general terms and conditions. If the 14th day falls on a weekend or a nationally recognised public holiday, the reflection period will continue until the end of the first subsequent working day. This reflection period does not apply to registration at the club. If you decide to cancel your membership within the 14-day reflection period, and the membership has not been used during that period, this cancellation will be free of charge. If the membership has been used during this period, Sportclub Match may charge a pro-rata fee (from the activation of the membership up to the day of cancellation, including any registration fee) for the membership.
  2. If you join Sportclub Match, you will owe membership fees from the moment of registration. The SEPA direct debit mandate will also apply from that moment. If you fail to meet your payment obligations, Sportclub Match may decide to terminate the agreement. Without a valid membership, Sportclub Match may deny you access to the club.
  3. When you join Sportclub Match, you are required to check in at the desk with your membership card upon entry.

ARTICLE 4: MEMBERSHIP, TERM

  1. We have various membership types, full details of which can be found on our website or at the club. All membership types provide unlimited access during the opening hours of Sportclub Match.
  2. During registration, you can indicate the membership type you wish to enter into an agreement for. All our fitness membership types can be entered into for 1, 6, or 12 months, with the exception of personal training. For personal training, a 3-month membership is possible. A one-month membership is exclusively with an automatic monthly direct debit renewal for an indefinite period. The 3, 6, or 12-month subscriptions can exclusively
    It is not possible to take out a 3-, 6- or 12-month subscription in advance with the aim of avoiding an announced price increase. Current rates are only valid at the time of purchase and do not apply retroactively. When taking out a new long-term subscription, the rate applicable at that time always applies.

ARTICLE 6: RATES AND PAYMENT

  1. All membership types have their own membership fee, which can be found on the website or at the club.
  2. All membership fees are payable and due in advance.
  3. If you opt for monthly payment, the first payment will be made at the reception desk upon registration. Subsequent payments will be collected monthly in advance via SEPA direct debit. Our collection period is one month. This means we will perform 12 direct debits per year.
  4. If we are unable to collect your payment for any reason (e.g. chargeback, insufficient funds, etc.), we will send the collection request to your bank again. If you do not meet your payment obligations, your Sportclub Match membership may be blocked until the payment obligation has been met.
  5. If you still fail to meet your payment obligation after we have served you with a notice of default, you will be in default. At that point, we can charge collection costs and we can send the claim to a collection agency. We can also terminate the agreement with immediate effect. At that point, you will owe all membership fees that would have been payable during the term of the agreement plus the collection costs that are charged.
  6. Once a year, with effect from 1 January, we are entitled to increase our rates by a maximum of 5%. If we exercise this right, this does not entitle you to terminate the contract, unless the rate increase takes place within three months of the contract being concluded, or exceeds 5%. Rate adjustments resulting from government measures may be implemented immediately, regardless of the amount, and do not entitle the customer to terminate the agreement.

Artikel 7: Openingstijden

  1. It may happen that there are different opening hours. For example, in the event of emergencies, a government order, or public holidays. Sometimes we will then (partially) close the gym. This may also be the case when we have to carry out work in the club.
  2. Sportclub Match is at all times entitled to adjust opening hours or close the gym in situations of force majeure, without this leading to a reduction in membership fees or termination of the agreement.
  3. We want to maintain our club properly and sometimes temporary or partial closures are unavoidable. In such cases, you are not entitled to a refund of membership fees.
  4. Sportclub Match is also closed every year on 25 December, 26 December and 1 January. These fixed closing days are part of the group lesson subscription and do not entitle you to a refund or compensation.

ARTICLE 8: GROUP CLASS AMENDMENT

  1. We want our course offerings to always be up-to-date. This means that we regularly adjust the content of the courses, the types of courses, and the course schedule.

ARTICLE 9: RELOCATING, PAUSING OR INJURY

a. Moving outside a 5-kilometre radius of the club is a valid reason to terminate your membership.

b. Pause. A subscription can be paused for a minimum of 2 weeks. Only a pause of at least 2 weeks, requested 7 days in advance and submitted via the designated and fully completed form with the desired start and end dates, will be honoured. It is not possible to claim a pause afterwards.

For group class subscriptions, there is a maximum pause duration of 4 weeks. For fitness subscriptions, there is a maximum pause duration of 2 months. Your spot or access will be retained within these periods; longer breaks are not possible.

  1. We hope you will join us for sports in good health. If, for medical reasons, you are permanently unable to use your membership, you can terminate it early with a notice period of 30 days from the notification. You must then provide proof that, given your medical situation, you are no longer able to make use of your agreement, for example, with a doctor's note.
  2. Suspension of your membership for any reason is not possible.

ARTICLE 10: TERMINATION OF MEMBERSHIP

  1. If you have entered into an agreement for a duration of one month, you can cancel it up to 14 days before the end of its term. If you do not do so, the agreement will be extended for the same period.
  2. You can cancel your agreement. You can do this by filling in the designated form on our website.
  3. We aim to create an environment within the club where everyone respects each other and rules are adhered to. If you fail to abide by the terms of the agreement, or if you fail to adhere to the house rules or display unacceptable behaviour, Sportclub Match may deny you access to the club and terminate the agreement (with immediate effect). The assessment of the situation is exclusively reserved for Sportclub Match.

ARTICLE 11: RISK AND LIABILITY

  1. Participating in sports can involve risks. By using our facilities, you must assess your own capabilities. You remain solely responsible for how you exercise and the choices you make. The use of our facilities is at your own risk. If you have any concerns about your physical condition, we recommend seeking expert advice from a doctor or specialist to determine the appropriate and achievable way for you to exercise.
  2. Sportclub Match and our employees are not liable for material or immaterial damage as a result of an accident or injury that you sustain in our clubs.
  3. Sportclub Match does not accept any liability for damage, loss or theft of your belongings.

ARTICLE 12: COMPLAINTS

  1. We are doing our utmost to be of service to everyone and want our club to provide as many people as possible with access to sports facilities. If you have any complaints, we regret that, but of course, we would be happy to hear them. You can email us for this.

Article 13: Personal Data

  1. To fulfil your agreement, we have your personal data. Sportclub Match processes your personal data in a fair and careful manner and within the framework of applicable laws and regulations, such as the General Data Protection Regulation (GDPR).
  2. Sportclub Match's privacy statement outlines the data we process, the purposes for which we do so, and how personal data is handled. It also explains how data subjects can exercise their rights concerning the processing of their personal data. You can find Sportclub Match's privacy statement on our website.
  3. To protect the safety of people and property in and around our club, we use video and audio surveillance equipment to monitor the club 24 hours a day. Video and audio surveillance is limited to the gym, and is not present in the toilet, shower, and changing rooms.

ARTICLE 15: APPLICABLE LAW AND DISPUTES
These general terms and conditions and all agreements entered into by or with Sportclub Match are exclusively governed by Dutch law.

ARTICLE 16: RENTING OUT SPACES AND COLLABORATION WITH SELF-EMPLOYED PROFESSIONALS

  1. Sportclub Match may rent out or make available parts of the premises, including the fitness room and Studio 7, to third parties for training sessions, group classes, or other sporting activities.

  2. For rentals, the rates and conditions set by Sportclub Match apply. Sportclub Match reserves the right to review these rates annually based on cost developments and market conformity.

  3. The tenant or user is responsible for the careful use of the space and must strictly adhere to the house rules of Sportclub Match. Any damage, loss, or injury during use shall be at the tenant's/user's expense and risk.

  4. Self-employed instructors (freelancers) who carry out activities within Sportclub Match or Studio 7 do so entirely at their own expense and risk and must have valid liability insurance.

  5. A collaboration with a self-employed professional does not constitute employment and does not grant exclusive rights to the use of facilities or the provision of specific classes.

  6. Sportclub Match reserves the right at all times to terminate the partnership or change the availability of a space, with one month's notice, unless otherwise agreed.

  7. All users, tenants, and freelancers are bound by the terms and conditions and house rules of Sportclub Match.

These general terms and conditions apply to all agreements and forms of use within Sportclub Match. In situations not covered by these terms, Sportclub Match reserves the right to make a decision based on reasonableness.
